Mnoho kupuj\u00edc\u00edch toti\u017e st\u00e1le \u017eije v domn\u011bn\u00ed, \u017ee rezerva\u010dn\u00ed poplatek je automaticky nevratn\u00fd. Aktu\u00e1ln\u00ed judikatura ale ukazuje, \u017ee realita je jin\u00e1.<\/p>\n<p><strong>D\u016fle\u017eit\u00e9 rozhodnut\u00ed Nejvy\u0161\u0161\u00edho soudu<\/strong><\/p>\n<p>Nejvy\u0161\u0161\u00ed soud \u010cesk\u00e9 republiky vydal v roce 2023 rozhodnut\u00ed jen\u017e je v\u00fdznamn\u00e9 a kter\u00e9 v\u00fdrazn\u011b posiluje postaven\u00ed kupuj\u00edc\u00edch na realitn\u00edm trhu. Soud jasn\u011b konstatoval, \u017ee rezerva\u010dn\u00ed poplatek nelze automaticky pova\u017eovat za smluvn\u00ed pokutu pouze proto, \u017ee nakonec nedojde k podpisu kupn\u00ed smlouvy.<\/p>\n<p>Jin\u00fdmi slovy \u2014 realitn\u00ed kancel\u00e1\u0159 si nem\u016f\u017ee rezerva\u010dn\u00ed poplatek ponechat automaticky jen proto, \u017ee obchod nebyl dokon\u010den.<\/p>\n<p>Rozhoduj\u00edc\u00ed je v\u017edy d\u016fvod, pro\u010d k uzav\u0159en\u00ed kupn\u00ed smlouvy nedo\u0161lo, a konkr\u00e9tn\u00ed podm\u00ednky sjednan\u00e9 ve smlouv\u011b.<\/p>\n<p><strong>Co je vlastn\u011b rezerva\u010dn\u00ed poplatek<\/strong><\/p>\n<p>Rezerva\u010dn\u00ed poplatek je \u010d\u00e1stka, kterou z\u00e1jemce skl\u00e1d\u00e1 realitn\u00ed kancel\u00e1\u0159i p\u0159i podpisu rezerva\u010dn\u00ed smlouvy. Jeho \u00fa\u010delem je zpravidla rezervace nemovitosti a jej\u00ed sta\u017een\u00ed z nab\u00eddky po ur\u010ditou dobu, aby m\u011bl kupuj\u00edc\u00ed prostor dokon\u010dit financov\u00e1n\u00ed a p\u0159ipravit kupn\u00ed smlouvu.<\/p>\n<p>V praxi se \u010dasto jedn\u00e1 o desetitis\u00edce a\u017e statis\u00edce korun, a proto je ot\u00e1zka jeho vr\u00e1cen\u00ed velmi d\u016fle\u017eit\u00e1.<\/p>\n<p><strong>Kdy m\u00e1te na vr\u00e1cen\u00ed rezerva\u010dn\u00edho poplatku n\u00e1rok?<\/strong><\/p>\n<p>Na vr\u00e1cen\u00ed rezerva\u010dn\u00edho poplatku m\u00e1te n\u00e1rok zejm\u00e9na tehdy, pokud:<\/p>\n<ul>\n<li>vystupujete jako spot\u0159ebitel (tedy fyzick\u00e1 osoba, nikoliv podnikatel nebo firma),<\/li>\n<li>rezerva\u010dn\u00ed smlouvu jste uzav\u0159eli s realitn\u00ed kancel\u00e1\u0159\u00ed nebo zprost\u0159edkovatelem,<\/li>\n<li>kupn\u00ed smlouva nakonec nebyla uzav\u0159ena,<\/li>\n<li>k neuzav\u0159en\u00ed do\u0161lo bez va\u0161eho zavin\u011bn\u00ed,<\/li>\n<li>do\u0161lo ke zm\u011bn\u011b podm\u00ednek obchodu nebo se objevily z\u00e1sadn\u00ed vady nemovitosti,<\/li>\n<li>prod\u00e1vaj\u00edc\u00ed neposkytl pot\u0159ebnou sou\u010dinnost nebo od obchodu odstoupil.<\/li>\n<\/ul>\n<p>V t\u011bchto situac\u00edch toti\u017e nelze kupuj\u00edc\u00edho sankcionovat ztr\u00e1tou rezerva\u010dn\u00edho poplatku.<\/p>\n<p><strong>Kdy naopak m\u016f\u017ee poplatek propadnout<\/strong><\/p>\n<p>Existuj\u00ed i p\u0159\u00edpady, kdy si realitn\u00ed kancel\u00e1\u0159 m\u016f\u017ee poplatek ponechat. Typicky tehdy, pokud kupuj\u00edc\u00ed bez relevantn\u00edho d\u016fvodu odm\u00edtne podepsat smlouvu odpov\u00eddaj\u00edc\u00ed p\u016fvodn\u00ed dohod\u011b nebo poru\u0161\u00ed sv\u00e9 smluvn\u00ed povinnosti.<\/p>\n<p>I zde v\u0161ak v\u017edy z\u00e1le\u017e\u00ed na konkr\u00e9tn\u00edm zn\u011bn\u00ed smlouvy a individu\u00e1ln\u00edch okolnostech p\u0159\u00edpadu.<\/p>\n<p><strong>Jak postupovat, pokud realitn\u00ed kancel\u00e1\u0159 odm\u00edt\u00e1 pen\u00edze vr\u00e1tit<\/strong><\/p>\n<p>Pokud v\u00e1m realitn\u00ed kancel\u00e1\u0159 odm\u00edt\u00e1 rezerva\u010dn\u00ed poplatek vr\u00e1tit, prvn\u00edm krokem by m\u011bla b\u00fdt p\u00edsemn\u00e1 v\u00fdzva k jeho vr\u00e1cen\u00ed. Form\u00e1ln\u00ed v\u00fdzva \u010dasto vede k mimosoudn\u00edmu vy\u0159e\u0161en\u00ed situace, proto\u017ee realitn\u00ed kancel\u00e1\u0159e si jsou aktu\u00e1ln\u00ed judikatury v\u011bdomy.<\/p>\n<p>Pro usnadn\u011bn\u00ed jsem p\u0159ipravil vzor takov\u00e9 v\u00fdzvy, kter\u00fd m\u016f\u017eete v podobn\u00fdch situac\u00edch vyu\u017e\u00edt.<\/p>\n<p><strong>Na co si d\u00e1t pozor do budoucna<\/strong><\/p>\n<p>P\u0159ed podpisem sv\u00e9 rezerva\u010dn\u00ed smlouvy je vhodn\u00e9 v\u017edy:<\/p>\n<ul>\n<li>vy\u017e\u00e1dat si n\u00e1vrh kupn\u00ed smlouvy p\u0159edem,<\/li>\n<li>zkontrolovat podm\u00ednky vr\u00e1cen\u00ed poplatku,<\/li>\n<li>ov\u011b\u0159it, kdy p\u0159esn\u011b poplatek propad\u00e1,<\/li>\n<li>nenechat se tla\u010dit do okam\u017eit\u00e9ho podpisu bez \u010dasu na kontrolu.<\/li>\n<\/ul>\n<p>Rezerva\u010dn\u00ed smlouva je pr\u00e1vn\u011b z\u00e1vazn\u00fd dokument a jej\u00ed d\u016fsledky mohou b\u00fdt finan\u010dn\u011b v\u00fdznamn\u00e9.<\/p>\n<p><strong>Z\u00e1v\u011brem tedy plat\u00ed<\/strong><\/p>\n<p>Rezerva\u010dn\u00ed poplatek nen\u00ed automaticky nevratn\u00fd. Rozhodnut\u00ed Nejvy\u0161\u0161\u00edho soudu z roku 2023 jasn\u011b potvrdilo, \u017ee kupuj\u00edc\u00ed nem\u016f\u017ee b\u00fdt sankcionov\u00e1n pouze za to, \u017ee k podpisu kupn\u00ed smlouvy nakonec nedojde.
